Former Denver Paramedic Found Guilty of Assault
DENVER – A former Denver paramedic faces up to 12 years in prison when he is sentenced next month for second-degree assault and false reporting. The paramedic who was driving him to Denver Health told police she heard what sounded like punching coming from the back of the ambulance where Miller was treating Smith. A Denver jury found Alan Miller, 31, guilty on Tuesday of assaulting a patient in an ambulance as he was being transported to Denver Health Medical Center. According to an affidavit obtained by 7News earlier this year, 39-year-old Tim Smith suffered a seizure and hit his head at his home on the night of Jan. 3.
Lunch’ promotes discussion
Students and faculty gathered Friday to engage in feeding their minds and their stomachs. “The Professors for Lunch Series” kicked off last week to discuss “The Unintended Reformation: How a Religious Revolution Secularized Society” — the latest book of Brad Gegory, professor of Early Modern European History. The event was the first in the Series, an initiative inspired by Political Science Professor Vincent Munoz’s desire to build the intellectual life for students on campus. “Notre Dame students are fantastically smart, but it seemed to me that we should offer them more to encourage their intellectual life beyond the classroom,” Munoz said. “We do a fantastic job of providing athletic activity beyond the classroom, and ND students are known for their athletic prowess, but I don’t think they’re known for their intellectual curiosity. I think it’s there, but the culture hasn’t developed.” Munoz said that this was an immensely student-driven event, reflecting on feedback that he collected from students in classes and in conversation. Morgan Pino, senior and undergraduate assistant to Munoz, said she met with Munoz to help coordinate the event. “His basic idea was that he wanted to bring the professors to the students,” Pino said. “He sees how busy we are and felt like the students don’t necessarily get intimidated, but find the professors a little inaccessible.” Since students eat meals in the dining halls three times per day, Pino said they decided to host the event during a meal to help Notre Dame students find time for intellectual life in their busy schedules. The talks, Pino said, feature a group meal before a question-and-answer session and general conversation. Senior Laura Taylor, a participant in the talk hosted by Gregory, said the convenience of the talks gave the already-attractive event extra allure. “I was very excited about the event because it offered a ton of students from all majors the opportunity to witness a lecture from one of Notre Dame’s most renowned professors,” Taylor said. “Even better, it was offered at lunch a much more convenient time of day for most students … and it was held at an easily accessible location.” Student government’s Neal Ravindra, director of academic affairs, helped to coordinate further logistics of the event and helped attract students. “Originally [Pino] and Professor Munoz reached out to us and asked if we wanted to help promote the event and get students to come,” Ravindra said. “We mainly helped to hammer out details and to direct logistical things like advertising.” Ravindra said student government representatives are excited about the series, and would love to see it continue in the future. “We are very glad for the opportunity to provide students with this cross-disciplinary experience and to see them pursue learning outside of the classroom that’s not necessarily going to be for anything other than their intellectual development,” he said. Ravindra said the events were planned around three specific goals outlined by Munoz to nurture, help and create. “Our goals are to nurture undergraduate intellectual life beyond the classroom, to help create an interdisciplinary intellectual community among the faculty and between faculty and students and to create a forum for learning for the entire Notre Dame community, while recognizing and celebrating outstanding faculty achievements,” Ravindra said. Taylor said she plans to attend more lunches because she appreciated the opportunity to engage intellectually with faculty and students from diverse disciplines. Also, she is excited by its potential to have a positive impact on the Notre Dame community. “The atmosphere at Notre Dame is definitely one centered on academic performance; this is wonderful, but it allows students to get too wrapped up in their specialized courses of study,” Taylor said. “These opportunities for discussion are an excellent chance to broaden our minds and expose ourselves to the incredible breadth of knowledge that is being shared by our professors.” Freshmen Matt Hing of Dillon Hall and Kendra Reiser of Pangborn Hall also attended the event, and said that they enjoyed the chance to hear one of Notre Dame’s prominent professors discuss his work. “Professor Gregory is an engaging professor in class, so I wanted to hear him outside [of class],” Hing said. Resier echoed Hing’s thoughts. “I wanted to attend the event because I wanted to learn more about how religion can play a stronger role in the institution that we have,” Reiser said. Munoz said judging from the feedback of the first event, he envisions holding this event more frequently. “I think we’ve hit upon a good idea,” Munoz said. “We’re doing it to make life at Notre Dame more interesting for the students. The focus is on creating an event that would resonate with the students, what would be intellectually engaging for them. We want to not only cater to their interests, but elevate them.”
Tropical wave development threatens Gulf of Mexico, Caribbean Sea
According to the National Weather Service, the first tropical wave, nearing the Windward Islands, has a 50 percent chance of becoming a tropical depression late this week or weekend in the Caribbean Sea.Warning Coordination Meteorologist Roger Erickson this system could be in the Gulf of Mexico by early next week.The second tropical wave, far out in the Atlantic, has a 70 percent chance of becoming a tropical system later this week as it approaches the Caribbean Sean. The National Hurricane Center is monitoring two tropical waves in the Atlantic Ocean.

Donating blood is a simple way almost anyone can save up to three lives. The actual donation only takes 10-15 minutes, but there are steps that come before and after donation that keep donors and the blood supply safe and healthy. He remains a member of the United States Army Reserve and has done two tours of duty in Afghanistan.TV report says Shawnee Mission has most staff members with $100,000 salaries. A report from KSHB looked at the number of staff members who make more than $100,000 per year in each of five school districts in the area. Of the five, Shawnee Mission had the most, with 76 staff members earning that level of pay. Olathe and Blue Valley were the next highest in the number of employees with that salary. Nine Shawnee Mission staff members earning that much were cut last year as part of removing $1.8 million in administrative costs. Unless you just redesigned your website, it could probably use a revamp. There a lots of things to keep in mind to make sure the new version of your website rocks, and content is one of those. But content for the emerging adult demographic is important because they’ll need guidance to make some pretty big decisions soon (think college, first jobs, buying their first cars).What do you mean by useful content?To put it simply, useful content is simply content that helps your customers, preferably within the realm of your expertise. So, if you’re a financial institution,content that young adults will find helpful could mean everything from tips about budgeting for a new car to an infographic about how much one person could save by taking meals from home to work for lunch.An important caveat is that helpful posts are not boring posts. Content can get away with not being 100% practical if it’s incredibly interesting and relevant to what you do. For example, an infographic on jobs that didn’t exist five years ago doesn’t specifically solve your customers’ money problems, but it’s interesting and relevant (particularly if you’re a college student trying to figure out which major will make you money).And don’t forget about segmentation! Remember that you have customers in different phases of their lives, so target your content to those life phases in order to reach your customers where they are. Emerging adults need content for the decisions they’re going to make now.Why include it in my site redesign?Having a place on your website for all your content is the best way to organize it (not to mention bring potential and current customers to your website). Court committee sees no need for additional DCAs Court committee sees no need for additional DCAs There is no need for a sixth district court of appeal in Florida or for realigning the boundaries of the existing five DCAs, according to a committee that has been studying the appellate courts and their workloads.There is a need, though, for two new appellate judges, one each in the Second and Fourth DCAs. The continued use of per curiam affirmed opinions also creates a perception problem for the district courts, the committee found.The District Court of Appeal Workload and Jurisdiction Assessment Committee was charged by the Supreme Court last February with studying the DCAs and recommending any changes necessary. That could include creating a new DCA, or shifting the boundaries of the existing appellate courts.The panel, chaired by First DCA Judge Philip J. Padovano, found neither necessary. He filed the panel’s report with the court on November 15.“The committee was to recommend an increase, decrease, or realignment of the appellate districts only if that course of action proved to be necessary and then only if the benefits of taking the action would outweigh the potential disruption,” the committee committee report said. “Every proposal or suggestion that was considered by the committee was measured against this standard.”On the number of DCAs, the committee noted that while some parts of Florida have grown faster than others, that hasn’t directly led to an increase in caseloads, and all the DCAs continue to dispose of cases in a timely manner. The legislature a couple years ago considered but did not pass a bill mandating the creation of a sixth DCA in Southwest Florida. That bill raised constitutional questions about whether the legislature could create a new DCA without its need first being certified by the court.“Although the caseload of each district court of appeal in Florida is above the national average, the judges in all of the courts appear to have adequate time to review the records and briefs, to hear oral argument, and to prepare written opinions when appropriate…,” the report said. “The committee’s reasoning is that there is simply no evidence of adverse conditions that would warrant such a disruption to the appellate system and there is no indication of a larger public or user demand for such a change.”Susan Fox, chair of the Appellate Practice Section, said the section advocated not changing DCA boundaries or adding a new DCA.“All the courts seem to be functioning reasonably well,” she said. “The gains of evening out the numbers so that each court has the same workload would not offset the costs that would be inherent in making such a huge adjustment.”Further, Fox said, such a fix might prove to be temporary because “the numbers are always going to be in flux, because we don’t know where the growth patterns in this state are going to be.”On changing DCA boundaries, the report said the committee spent considerable time looking at that issue, especially since case-loads have dropped in recent years in the Third DCA, and its workload per judge is considerably lower than other district courts.The panel said it had insufficient time to thoroughly study the matter, but found no indication the disparity was caused by any poor operation at the Third DCA or was causing any other problems. It also looked at suggestions to move the 20th Circuit from the Second to the Third DCA to help equalize workloads or reassign a judge from the Third to another district, but concluded that “would be an overly disruptive solution to a problem not proven to exist.”The committee did strongly endorse adding a judge each to the Second and Fourth DCAs, something the Supreme Court has sought for the past two years, but has not been approved by the legislature.The committee also concluded that no new branch courthouses are needed, noting that such a branch has been proposed in the Second DCA for Southwest Florida. It noted that unlike trial lawyers, appellate lawyers have to appear in court much less frequently and much of their work is submitted in writing.In addition, a new branch in the Second Circuit might lead to requests for branch appellate courthouses in Gainesville, Jacksonville, and Pensacola in the First Circuit and Orlando in the Fifth Circuit.“The concern of the committee is that a recommendation of a new branch court in any district might cause a chain reaction that would result in numerous other branches in other districts, leading to decentralizing the appellate court system,” the report said.Likewise, the committee recommended not having “chambers dispersion” of the appellate judges, which would allow them to work in their home cities similar to federal circuit court of appeal judges.The state doesn’t have a network of offices or courthouses (local courthouses are under county control) to accommodate such a system, the committee said. It could also create logistical problems for clerks and disruption of rotation and panel assignments, and cost more money. On the positive side, it would encourage more applicants in outlying areas because they wouldn’t have to relocate.“The concept of chambers dispersion deserves serious consideration and it may become more feasible as technology advances,” the report said. “However, the court system should not commit itself to such a course until the potential problems have been fully identified and considered and it is certain that the advantages outweigh the disadvantages.”Other recommendations include continuing to improve technological abilities, including video oral arguments and electronic filing, and continuing to use associate (circuit judges temporarily assigned to a DCA) and senior judges on appellate cases.The committee took no position on per curiam affirmed decisions, but noted, “Some litigants and lawyers believe that per curiam affirmances are sometimes issued because the courts are too busy, because the courts do not wish to explain their decisions, or because the courts wish to foreclose discretionary review in the Supreme Court. While no evidence was found by the committee to support any of these possibilities, the very fact that these perceptions are held should be a matter of concern to the courts.”The 15-member committee included one judge from each DCA, plus a circuit judge and lawyer from the jurisdiction of each DCA. It was appointed pursuant to Rule of Judicial Administration 2.241, which sets out standards for reviewing the DCAs and/or changing the boundaries or number of appellate courts.The panel sent surveys to judges, lawyers, litigants (including inmates and the general public, and had a public hearing in September. The report noted the committee generally got a low response to its surveys and only four people testified at the public hearing. It also reviewed a huge amount of statistical data, including case filings, filing trends, dispositions, court staffing levels, caseloads, and similar information.“It is important to note that much of the descriptive information generated for this committee should be viewed only as baselines or guideposts for future assessments, as well as the branch’s ongoing quality management and accountability efforts,” the report said. “The committee emphasized the ongoing necessity for the district courts to be vigilant in monitoring emerging concerns and be proactive in developing strategies to ensure that the courts are responsive to the needs of the people.”Among the committee’s other findings are: • Except for the Third DCA, caseloads and filings are rising, especially in the Second and Fourth DCAs. Second DCA Judge and committee member Charles Canady said he believes the number of PCAs is related to the heavy caseload in that court. Filings per judge are expected to exceed 400 in all DCAs this year except the Third, where it is projected at 290. The report also noted that unlike the other DCAs, the Third does not have a central staff of attorneys to help with its workload.• “Pro se filings appear in approximately 60 percent of cases; filings by inmates in state custody constitute a majority of these,” the report said.• Chances of getting an oral argument are much higher in the Third DCA than in other districts. Twenty-two percent of all dispositions in the Third DCA are subsequent to oral argument, while the second highest rate is in the Second DCA with 7.8 percent.• “The most noteworthy challenge to the public’s trust and confidence in Florida’s district courts of appeal stems from the practice of issuing per curiam affirmed (PCA) opinions,” the report said. “While there are longstanding reasons for this practice, including the fact that it supports the district courts’ effectiveness in clarifying the law and efficiency in disposing of cases, it is clear that the use of PCAs remains of great concern to attorneys, litigants, and the public.” The committee also noted while experienced attorneys might understand the basis of a PCA and be able to explain that to their clients, pro se litigants likely do not.
